Terms of Use
Last updated : 8 août 2026
These general terms govern access to and use of the Hia application. By creating an account or placing an order, you accept them in full. We encourage you to read them carefully.
1. Purpose
Hia is a platform connecting users with partner merchants — restaurants, bakeries and grocers — offering exclusive deals on their food products, ordered through the app and collected in store.
2. Our role
Hia is a technical intermediary.
We do not prepare, sell or transport any food product. The contract of sale is concluded directly between you and the merchant. The merchant alone is responsible for the quality, composition, hygiene, storage and compliance of the products offered, and for observing the applicable food-safety regulations.
3. User account
- You must be at least 16 to create an account.
- You undertake to provide accurate information and keep it up to date.
- You are responsible for keeping your credentials confidential and for actions taken from your account.
- One account per person. We may suspend an account used fraudulently, abusively, or contrary to these terms.
4. Orders and prices
- Prices are set freely by the merchant and shown in Tunisian dinars (TND), inclusive of tax where applicable. Advertised reductions are stated against the establishment’s usual selling price.
- The total is calculated and confirmed by our servers before you place the order. That amount is the one that applies.
- Where an offer is presented as a surprise, its exact contents are not known in advance: the merchant commits to the category and value of the offer, not to its itemised contents. This is stated on the offer listing before you order.
- Quantities are limited. An order is only firm once confirmed by the merchant.
5. Payment
Payment is made directly to the merchant at pickup (cash or a method accepted on site). Hia collects no payment and stores no banking data.
6. Pickup, cancellation and no-shows
- You must collect your order during the pickup window shown in the app, presenting your order code.
- You may cancel an order from the app for as long as the merchant has not yet prepared it.
- The merchant may cancel an order, in particular if stock runs out or the shop closes unexpectedly. You are informed by notification.
- An order not collected within the stated window may be resold by the merchant, without compensation or refund. Repeated cancellations or no-shows may lead to account suspension.
7. Reviews and posted content
- You may only review an order you actually placed and collected.
- Content must be honest and respectful. Prohibited: abusive, defamatory or discriminatory remarks, illegal content, third parties’ personal data, advertising.
- We may hide or remove any content that breaches these rules.
- By posting a review or photo, you grant us the right to display it in the app.
8. Acceptable use
In particular, you may not:
- create multiple or fraudulent accounts;
- access the service through unauthorised automated means (bots, scraping scripts);
- attempt to circumvent security measures or disrupt the service;
- resell products obtained through the platform.
9. Liability
Hia works to keep the app available and its information accurate, without guaranteeing it will be uninterrupted or error-free. We cannot be held liable for:
- the quality, food safety or compliance of products, which are the merchant’s responsibility;
- the cancellation or unavailability of an offer by a merchant;
- service interruptions beyond our control.
These clauses apply within the limits permitted by Tunisian law, in particular consumer-protection regulation.
10. Suspension and termination
You may delete your account at any time (procedure). We may suspend or terminate an account for serious or repeated breaches of these terms, having informed the user where possible.
11. Intellectual property
The Hia brand, the app, its code and its content are protected. No reproduction or reuse is permitted without prior written agreement.
12. Changes to these terms
These terms may be amended. For any substantial change, you will be informed in the app. Continued use constitutes acceptance of the version in force.
13. Governing law
These terms are governed by Tunisian law. In the event of a dispute, an amicable resolution will be sought first by contacting us at the address at the bottom of this page. Failing that, the competent Tunisian courts will have jurisdiction.
